HELP JAMES

I started working at a place called Grocery Express. It was a job that I had gotten because of Vocational Rehabilitation. I started working there July 9th of 2003. I am pretty sure that is right. Through the course of my employment there I met lots and lots of people. A lot of them still remember me from there and I have made many aquaintences. Later on during my employment, the company was sold and re-named Pop Shoppe #3. I had a customer that would always come into the store and buy a paper or two. She would always pay with change and to me she was a very friendly lady. Her name was Dorothy. Now, Dorothy had been a regular customer of mine since I started working there, even before it was changed to Pop Shoppe #3. Well, one day Dorothy had someone with her. Dorothy introduced us and come to find out that the girl was her granddaughter. Dorothy would come in all the time, except for now, she would bring her granddaughter with her. I found out a little later that the girls name was Kristy. One day, her grandmother came into the store with Kristy and made her purchase. Kristy headed for their pick-up first and before dorothy left she told me that her granddaughter Kristy really liked me. I asked her how old she was and she told me that she was 16. After that Kristy began calling me at work and when they came to the store, her grandmother would wait in the pickup. She called me all the time, and would talk about how she was living with her grandmother Dorothy (who by the way she called mom). She told me that she lived with her because her mom didn't want her living with her. Her grandmother told me herself that "Kristy and her mother do not get along and that her mother did not like Kristy". During these phone conversations we talked about her mother, and about why she didn't have a car. She told me it was because her mom would not buy her a car until she took driver's education. Kristy told me that she didn't sign up for it this year and that it was to late, so she would take it next year. Kristy told me that she had gotten held back a year in high school, she said she was supposed to be junior and that she would be 17 on March 9th. One day she asked me to come and see her on her lunch hour. I did, and that is where all of this starts to turn south. I went to go see her and she wanted to go driving around. We drove for a while and we turned onto a road and parked. We were talking and I was looking out the driver side window. I turned to look at her and she had undressed. I won't go into detail but we didn't have sex. I was kinda freaked out by that and I took her back. She still called me all the time and came to the store. At one point I went to where her grandmother and her worked. The Sapulpa Laundry. Her grandmother and her both worked at the same time and I am pretty sure that the only reason she was there was to help her grandmother. I was told that her mother and father were the owners of that laundry and that her grandmother was running it for them. That turned out not to be true. I picked up Kristy one more time on her lunch hour. She told me where to drive and told me to turn here and go there. We ended up at a wooded area next to the Catholic church here in Sapulpa. We walked for a while and ended up having sex with her. I am not excusing my behavior, I was and still am a married man. I cheated on my wife and hurt my children. I don't know if my wife will ever forgive me and honestly I don't blame her if she didn't. I did not just go out and sleep with someone. I found out that the legal age of consent was 16 and that is the age that Kristy and her Grandmother both told me she was, and that she would be 17 within weeks. All of that was a lie. Kristy's real age was 15 going on 16. The only thing they didn't lie to me about was her birthday. It was on the 9th of March, but she wansn't going to be 17 she was going to be 16. Up to the point that I found that out, which was while I was sitting at the police station talking to the police detectives, I thought that I had commited adultery. I had no idea the trouble I had gotten into by sleeping with that girl. Statuatory Rape, the technical term is Rape in the Second Degree. God, what had I done. I was so scared and even more scared when I found out that I was not going home. I called my wife Machelle. They had picked me up at the house, but I had no idea why they wanted to talk to me. Like I said before, I didn't know that I had commited a crime. Machelle, came to the police station and I had to tell her why I was there. I was handcuffed to a bench, and told her with our daughter in her arms. I told her that I had cheated on her. Than I told her that the girl turned out to only be 15. She got very upset and started to kick me. She left and did not look back. At that moment, I broke her heart and probably our marriage was over. They took me to the Creek county jail where they booked me in. I was given an orange jumpsuit, which was to small and put in a cell. The cell was so overcrowded that some of us, myself included had to sleep on the floor underneath the bottom bunk. It was like crawling in and out of your own coffin. The jail looked as if it should have been condemned long long ago. I'm sure, but I bet that it already had been. They had been building a new jail for a while, which by the way is now complete. I spent a little over a month in that jail, 39 days. I spent most of those days and nights crying my eyes out to my wife Machelle, and crying to the inmates. I was so so hurt and scared. A lot of the inmates would tell me that I would end up killing myself when I got out. I know it felt like what they said was true. I got a court appointed attorney. It turns out that I he had NEVER tried a case like mine. He had only done alcohol and drug cases. He came to me with a deal that the district attorney offered, which was 2 10 year sentences to be run concurent. I took the deal and got out of that dungeon they call a jail. My attorney told me that I would have to register as a sex offender for the next 10 years and that I would be a felon for the rest of my life. I was Never informed about sex offender classes, or polygraphs, or that I would be a registered sex offender for the rest of my life. My attorney told me that the mother of the girl (Kristy), was pushing for me to be punished. Now I will have to agree that I did something very wrong, but when you are lied to, how can that be your fault? I know that parents are put in jail in the state of Oklahoma for their children's truancy from school. The state expects them to be responsible for their children and know where they are at all times. Now, why does that not apply to this situation. Why was I the one who was punished when her daughter was out sleeping around? I know for a fact that she was, do I have proof? You bet I do. I am not the only one that she lied to about her age, but I am the only one her mother insisted on pressing charges against. Do you think it's because my last name is Garcia? Yes, I think it is. I found out later after my plea "bargain" that Kristy had been and still is sleeping with a LOT of men. Married men, single men, white men, black men, boys in her school. She has this reputation and the D.A. was very well aware of it and still prosecuted. Should the mother not have any responsibility? Better yet, she was living with her Grandmother...why is she not held responsible? My probation officer talked to the D.A. and found out the details of the situation. He told me that the D.A. said that the girl was out doing this and that it really was not my fault. Now, if this was known why is my life over, like it's no big deal? I found out later that this girl Kristy got kicked out of school for performing oral sex on a male classmate. I was told that it was caught on tape. Once again I am not excusing what I did...I cheated on my wife. My sex offender counselor tells me that it's my fault because I didn't check her I.D. Now really, when was the last time you met someone and asked to see their I.D.

Her grandmother worked for the Sapulpa Laundry, I told you this earlier. The laundry was sold and the person who bought it also bought a laundry called the McKinley Street Laundry. They ended up hiring Kristy and keeping her grandmother Dorothy on. They moved Kristy to the Mckinley laundry. Now, the people that bought the laundries are Shelley and Eric. Mckinley is where we have done our laundry for 5 years. We continued to do our laundry their, but only when we knew she was not working and later after we knew she did not work there any longer. The new owner told my wife that the reason she fired her was because she kept trying to get her husband Eric to sleep with her. She also said that she would try to get the male customers to sleep with her. After she was fired, Shelley told my wife that some black guy came in asking for her. Shelley got a little upset and told the guy off. She asked him if he knew how old she was and he said yea, she is 21. She told him no, she is 15.

Ok, now that I am on probation. I have been accused of stalking this girl Kristy and her grandmother Dorothy. I was accused of driving slowly by the laundry where they worked and because she approached me at a local conveinience store ( Quik Trip) and tried to get me to talk to her. I did not talk to her, but the mistake I made was to stand there staring into the store while she talked to my back. She told me that her mother was the one who did all of this and that she was going to try and get the charges dropped. I should never have stood there and listened to her, but when someone tells you that they are sorry for ruining your life, you get a little emotional about the prospect of having your life back to normal. Her mother accused me of following them. All of these accusations were untrue. For one thing the times that I was being accused of driving by the laundry really slow was when Kristy and Dorothy were both fired from the laundry's and banned from being there. Her mother stated that she was in the laundry getting change for Kristy's medication. Now if she was banned from the laundry, how could she have been there? She wasn't because we checked. The person working the laundry on those dates said that they were never in the laundry. She also said that I was following her to the local Wal-Mart. My wife Machelle has worked at that Wal-Mart for a year, and yet I am following them. I was there picking my wife up for lunch, dropping her off and shopping for groceries, you know things you do when your spouse works at Wal-Mart and things you do when your just a customer. But I was accused of stalking her. What a joke. The judge we went in front of for the charges went ahead and granted a restraining order. He also told the mother Deona Dale and the grandmother Dorothy that in a small town you will run into each other. Then he said that if they don't want to run into me that they need to find another Wal-Mart to shop at. Now here is where it gets really messed up. Kristy and Dorothy are the ones who are stalking and harrasing. They are doing it to my wife. They come to Wal-Mart all the time, which is normal and alright, but they make a point to go to my wife's line. Now why would they do that, but only to harrass her? Today March 14, 2005, my wife Machelle was working the service desk and my wife was busy and didn't notice but one of her co-workers, Stacie, said that Kristy stopped in front of the service desk and just stood there staring at Machelle. Kristy also brought in one of the guys that she had lied to. This guy was 21 and married. I know how old he was because he talked to my wife Machelle, during their conversation he told her how old he was. On other occations, this guy came through Machelle's line with his wife and little baby girl. Machelle mentioned to her about Kristy and apparently the wife knew that her husband had been with Kristy. I am told constantly by my wife that Kristy and her grandmother have tried to talk to her or gone through her line on purpose. Now, there are many many checkouts, why use hers? It's to get to harrass her and rub it in her face. My wife finally told them not to come through her line, they did not listen and continued to frequent her checkout. Kristy and Dorothy are now messing with my wife's job and the job's of her close friends that she works with. The find reasons to go and make complaints to management, but management knows about the situation. When Kristy and Dorothy walk in the door, my wife is warned about it and they try to move her to a location where she would be hard to find. My wife Machelle has to deal with this all the time, and according to what we have been told, there is nothing she can do.

I spoke wth the judge that presided over my case. I told him the situation and he told me that he never would have given me what they gave me. He felt that I did not get a fair sentence. The judge informed me that he is not given the details when a plea "bargain' is entered to the court. He than told me to contact a local attorney that he knows and to tell them that he sent me. Since, then I have spoken to my cousin Ricky, who told me about an attorney in Norman, Oklahoma that is very good. I am trying to raise money to get this attorney, and that is why I have built this website.

I am asking for you help. I am asking for donations to hire an attorney. My mom had talked to an attorney in California that told her they could get the charges dropped. They, however cost a fortune. The fact of the matter is, if you don't have money than you don't have a leg to stand on. I am asking for that leg to stand on.
